This End User License Agreement ("EULA") is a legal agreement between you and Secret Castle Games for the use of our software products including Ebullition LBVR and other games and applications.
1. Grant of License
Secret Castle Games grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the software solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
2. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the software
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the software
- Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Secret Castle Games
- Use the software for any illegal or unauthorized purpose
3. Intellectual Property Rights
The software and all worldwide copyrights, trade secrets, and other intellectual property rights therein are the exclusive property of Secret Castle Games. All rights not expressly granted to you are reserved by Secret Castle Games.
4. Virtual Reality Content
Our VR software may cause motion sickness, disorientation, or other discomfort. By using our VR software, you acknowledge:
- You are physically capable of participating in VR experiences
- You will immediately stop using the software if you experience any discomfort
- You are using the software at your own risk
- You have adequate physical space for safe VR gameplay
5. Updates and Modifications
Secret Castle Games may from time to time provide enhancements or improvements to the features/functionality of the software, which may include patches, bug fixes, updates, upgrades and other modifications.
6. Term and Termination
This Agreement shall remain in effect until terminated by you or Secret Castle Games. We may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement.
7. Disclaimer of Warranties
The software is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Secret Castle Games disclaims all warranties, whether express, implied, or statutory.
8. Limitation of Liability
In no event shall Secret Castle Games be liable for any consequential, incidental, indirect, special, punitive, or other loss or damage whatsoever arising out of or relating to your use or inability to use the software.
9. Governing Law
This Agreement shall be interpreted and governed by the laws of the jurisdiction in which Secret Castle Games is located, without regard to its conflict of law provisions.
